Campaign Finance Guide for Political Committees

Campaign Finance Guide for Out-of-State Political Committees

Getting Name and Address Right

Are you a political committee making contributions? Help candidates and officeholders comply! When a political committee makes a political contribution, ensuring that all of the information is provided to the recipient of your contribution can help them report it properly. To ensure the recipient of your contribution has the information they need, please consider these points:

Committee Name: When making a contribution, provide the recipient with the full name of your political committee. For the full name, you can refer to the committee’s name on your most recent campaign treasurer appointment.

Committee Address: Always provide the recipient with the political committee’s full address.

Out-of-State Committees: If you are an out-of-state committee, please see the Campaign Finance Guide for Political Committees available on our website.

Reminder: A political contribution made by a committee is reported on the committee’s own report as a “political expenditure”.

Steps to follow if you missed a filing deadline

You missed the filing deadline if:

  • You filed your report late, or
  • You have not filed your report at this time and the deadline has passed.

You have the option to request a waiver or reduction of an assessed penalty for filing your report late. You can do this by submitting an Affidavit of Defense to your filing authority. The Texas Ethics Commission (TEC) considers every Affidvait of Defense submitted to the Commission AFTER the specific report is filed.

STEP 1: Fill out an Affidavit of Defense (to raise a defense to late filing). Fill out this affidavit on your computer.
State the name of the report that you filed late and state the due date for that report. Explain the circumstances that prevented you from filing your report on time. Request a waiver or reduction of assessed penalties if this is what you are requesting.

STEP 2: Have your affidavit notarized OR fill out the unsworn declaration.

STEP 3: Using one of the two methods below, deliver your completed Affidavit of Defense to the Texas Ethics Commission.

  • Email a PDF copy of your completed Affidavit to affidavits@ethics.texas.gov.
Include your Filer ID, name, AFFD, and report type in the subject line.
    For example:
Subject Line: “00012345 Jane Doe, AFFD, January 2026 Semiannual late filing”
  • Mail a paper copy of your completed form to:
    Texas Ethics Commission
    P.O. Box 12070
    Austin, TX 78711-2070

After TEC receives your Affidavit of Defense and after you have filed the report in question, the Texas Ethics Commission will consider your request. You will be notified of the Commission’s decision.

Political Fundraising

Political Advertising: What You Need to Know

December 12, 2026:  Last day to accept political contributions before the 2027 Regular Legislative Session.
June 21,2027:  First day to accept political contributions after the 2027 Regular Legislative Session.

The 2027 Regular Legislative Session convenes on January 12, 2027. Please note that December 12, 2026, is the last day on which certain legislators, certain statewide officers, and certain political committees may accept contributions. The moratorium on accepting contributions begins December 13, 2026, and continues through June 20, 2027.

Who is Subject to the Moratorium

The following are subject to the moratorium:

  • Statewide officeholders, including officeholders-elect, but excluding judicial officeholders;
  • Members of the legislature, including members-elect;
  • Specific-purpose committees that support, oppose, or assist a statewide officeholder or member of the legislature; and
  • Legislative caucuses.

However, a statewide officeholder or member of the legislature who was defeated at the November 3, 2026, general election is not subject to the moratorium, nor is a specific-purpose political committee that supports or assists only such an officeholder or member.

Contributions That Are Not Subject to the Moratorium

The moratorium DOES NOT apply to a political contribution that was made and accepted with the intent that it be used:

  1. in an election held or ordered during the period beginning December 13, 2026, and continuing through June 20, 2027, in which the person accepting the contribution is a candidate if the contribution was made after the person appointed a campaign treasurer with the appropriate authority and before the person was sworn in for that office; or
  2. to defray expenses incurred in connection with an election contest.

Ethics Advisory Opinion No. 351

Whether incumbent justices re-elected to the Supreme Court and the Court of Criminal Appeals and justices newly elected to those courts in November 1996 may accept political contributions during the period beginning on December 15, 1996, and ending on March 5, 1997.
